Costs

At Rutherfords LLP we are conscious that cost is a major concern when considering obtaining legal advice.

We are transparent on legal costs and acknowledge that clients want to know exactly how much their legal costs are going to be. With thisin mind, we offer fixed and capped fee services in respect of our fees.

We would ask that the fixed/capped fee is paid in advance or by way of manageable instalments. If paid in advance in full then clients will benefit from a 10% discount of their legal fees.


Iceberg Client Credit

We recognise that funding for matrimonial disputes can be problematic as the assets are often ‘tied up’ until the settlement has been reached. In respect of financial disputes, we are able to offer our clients a client credit facility in association with Iceberg client credit.

By opening a client credit account it allows you to finance your legal costs (subject to status) and then you pay back the loan once you receive your settlement.


Initial Advice

We offer an initial 30 minutes free no obligation consultation. At this meeting we discuss all issues relating to your matter and advise you of your options.

Divorce/ Civil Partnership Dissolution (Undefended)

Our costs in relation to an undefended divorce are £900 (including VAT). We manage the whole divorce process for you right up to the obtaining of your Decree Absolute.

If you have been served with divorce proceedings and are in agreement with the divorce then our divorce response service is £360.00 (including VAT).

Contested divorce proceedings are rare and costly. For this reason, we are unable to offer a fixed fee for this service and can provide a quotation in accordance with your situation.

Note: There is a mandatory court fee of £550.00 payable on the issue of your divorce petition. If you are on a low income you may be exempt from all or part of the fee.


Financial Resolution

Our costs for negotiating financial matters to include the collating of financial disclosure and preparation of a final order are between £960 - £1,800 (including VAT), depending on the complexity of your matter.

If you are unable to settle the financial issues informally and court proceedings need to be issued then our costs for the first hearing are between £2,400 to £3,600 (including VAT), depending on the complexity of the matter. The costs for the second hearing are between £6,000-£8,000 (including VAT), depending on the complexity of the matter. Most cases settle at either the first or second hearing.

The costs for a final contested hearing is subject to quotation once the case has been set down. This depends on the factual issues in dispute and complexity of your case.

Note: There is a mandatory court fee of £255.00 payable upon the issue your financial remedy claim. If you are on a low income you may be exempt from all or part of the fee.


Children Matters

Our costs for negotiating issues regarding children disputes is £960 to £1,120 (including VAT), depending on the complexity of your matter.

If you are unable to settle your dispute and court proceedings have to be issued then our costs for the first hearing are £960 (including VAT). The costs for the second hearing are between £1,800 -£4,800 (including VAT) depending on the complexity of your case.

The costs for final contested hearings are subject to quotation once the case has been set down. This depends on the factual issues in dispute and complexity of your case.

Note: There is a mandatory court fee of £215.00 payable upon the issue of your court application. If you are on a low income you may be exempt from all or part of the fee.


Agreements

Our costs for the preparation of Separation Agreements, Cohabitation Agreements and Pre-Nuptial Agreements is £780.00 (including VAT).

Cohabitation/ Property Disputes

Property disputes for unmarried couples are governed under the law of trusts. Due to the complexity of this area of law we are unable to offer a standard fixed fee. However, we may be able to provide a more accurate quotation once we receive full details of your case.
