Mediation and Dispute Resolution

Mediation is a confidential voluntary “without prejudice” process in which an impartial third party, known as a mediator, helps you to discuss and negotiate all issues surrounding divorce, separation, finances and children matters.

Both parties have to agree to mediation and mediation looks at the common ground and positive aspects to help find the best resolution between the parties.

The mediator spends time with each party, both in joint sessions and in private meetings helping each party to focus on their interests and the interests of the other party, rather than their rights. If no agreement is reached the parties are not bound by what has been discussed.

If an agreement is reached specifically with regard to financial matters relating to married couples, then the terms of that agreement can then be secured into a Consent Order approved and sealed by the Courts (see Financial Resolution above).

Lawyers can assist in facilitating mediation and securing the terms of any an agreement reached at mediation into an Order of the Court.
