Professional Negligence

Professional advisers have a high duty to their clients to provide professional advice.

If the advice they have provided is negligent (the advice is not at the level of expertise which you are entitled to reasonably expect) and a loss has resulted it may be possible to make a claim against that organisation for the losses which are caused by that negligent advice. Virtually all professional advisors are obliged to have high levels of insurance cover.

Rutherfords Solicitors has significant experience in dealing with many different types of professional negligence claims.

Professional negligence is a complex area of law and it is very important that you instuct a solicitor with experience in this area. At Rutherfords we will be able to advise you on the duties owed by the professional advisor and how to prove the losses you have sustained. For instance, in calculating your losses you will have to establish the losses and show that the losses would not have occurred if you had been properly advised (the 'but for' or 'loss of chance' test).

Claims can be made against:

  • Accountants
  • Architects
  • Auditors
  • Insurance Brokers
  • Other Professionals
  • Solicitors
  • Stockbrokers
  • Surveyors
  • Valuers
